Special Courts and child-protective procedure
The POCSO Act provides for Special Courts and contains safeguards concerning evidence, dignity, privacy and in-camera trials. The role and rights of each person differ, so advice must be based on the actual proceeding.
Identity must be protected
Section 33 addresses protection of the child’s identity during investigation and trial, including information capable of revealing family, school, relatives or neighbourhood. Section 37 provides for in-camera trials.
- Do not publish names or photographs
- Do not identify a school or neighbourhood
- Keep case papers private
- Seek advice before sharing digital material
Immediate and careful preparation
